Deutsche Fassung<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Endbenutzer-Lizenzvertrag (EULA) f\u00fcr Digitale G\u00fcter<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u00a7 1 Vertragsgegenstand<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"> (1) Dieser Endbenutzer-Lizenzvertrag (EULA) regelt die rechtlichen Bedingungen f\u00fcr die Nutzung der von Vanessa Jung, Jungbuschstra\u00dfe 18, 68159 Mannheim (nachfolgend \u201eLizenzgeberin\u201c) \u00fcber <a href=\"https:\/\/vanessajung-guitar.de\/en\/\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/vanessajung-guitar.de<\/a> angebotenen digitalen Inhalte (insbesondere Noten, Tabulaturen und Audio-Downloads; nachfolgend \u201eDigitale G\u00fcter\u201c). (2) Mit dem Erwerb und Download der Digitalen G\u00fcter stimmt der Kunde (nachfolgend \u201eLizenznehmer\u201c) den Bedingungen dieser EULA zu.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u00a7 2 Einr\u00e4umung von Nutzungsrechten<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"> (1) Die Lizenzgeberin r\u00e4umt dem Lizenznehmer ein einfaches, nicht \u00fcbertragbares und zeitlich unbegrenztes Recht ein, die Digitalen G\u00fcter f\u00fcr private Zwecke zu nutzen. (2) <strong>Live-Auff\u00fchrungen:<\/strong> Abweichend von der rein privaten Nutzung ist es dem Lizenznehmer ausdr\u00fccklich gestattet, die in den Digitalen G\u00fctern enthaltenen musikalischen Werke f\u00fcr eigene \u00f6ffentliche Live-Auff\u00fchrungen (z. B. Konzerte) zu nutzen. Etwaige Geb\u00fchrenpflichten gegen\u00fcber Verwertungsgesellschaften (z. B. GEMA), die durch den Veranstalter zu tragen sind, bleiben hiervon unber\u00fchrt.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u00a7 3 Nutzungsbeschr\u00e4nkungen &amp; Erlaubter Fan-Content<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"> (1) Grunds\u00e4tzliche Beschr\u00e4nkungen: Es ist dem Lizenznehmer ausdr\u00fccklich untersagt, die Digitalen G\u00fcter (die Dateien an sich) an Dritte weiterzugeben, zu verkaufen, zu vermieten, gewerblich zu verwerten oder unautorisiert im Internet hochzuladen. (2) <strong>User-Generated Content (Fan-Covers):<\/strong> Ausdr\u00fccklich gestattet ist die Erstellung und Ver\u00f6ffentlichung eigener, vom Lizenznehmer selbst eingespielter Audio- oder Video-Aufnahmen (Covers), die auf der Grundlage der Digitalen G\u00fcter basieren, auf Social-Media-Plattformen (z. B. YouTube, Instagram, TikTok). Diese Gestattung gilt nur, sofern die Ver\u00f6ffentlichung durch den Lizenznehmer nicht prim\u00e4r kommerziellen Zwecken dient.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u00a7 4 Urheberrecht<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"> Die Digitalen G\u00fcter sind urheberrechtlich gesch\u00fctzt. Alle Rechte an den Inhalten, insbesondere die Urheber- und Leistungsschutzrechte, verbleiben vollumf\u00e4nglich bei der Lizenzgeberin.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u00a7 5 Vorzeitiges Erl\u00f6schen des Widerrufsrechts<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"> Bei Vertr\u00e4gen \u00fcber die Lieferung von nicht auf einem k\u00f6rperlichen Datentr\u00e4ger befindlichen digitalen Inhalten erlischt das Widerrufsrecht des Verbrauchers vorzeitig, wenn der Vertragserf\u00fcllungsprozess (z. B. der Download) begonnen hat, nachdem der Verbraucher hierzu seine ausdr\u00fcckliche Zustimmung erteilt und gleichzeitig seine Kenntnis davon best\u00e4tigt hat, dass er sein Widerrufsrecht mit Beginn der Vertragsausf\u00fchrung verliert. Dies wird technisch durch eine Best\u00e4tigung im Checkout-Prozess sichergestellt.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u00a7 6 Zuwiderhandlungen<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"> Bei einem Versto\u00df gegen die Bestimmungen dieses Vertrages erlischt das Nutzungsrecht des Lizenznehmers mit sofortiger Wirkung. Der Lizenznehmer ist in diesem Fall verpflichtet, s\u00e4mtliche Kopien der Digitalen G\u00fcter unverz\u00fcglich zu l\u00f6schen. Die Lizenzgeberin beh\u00e4lt sich die Geltendmachung von Schadensersatz- und Unterlassungsanspr\u00fcchen ausdr\u00fccklich vor.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. Englische Fassung<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>End User License Agreement (EULA) for Digital Goods<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u00a7 1 Subject of the Agreement<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"> (1) This End User License Agreement (EULA) governs the legal terms and conditions for the use of the digital content (in particular sheet music, tablatures, and audio downloads; hereinafter &#8222;Digital Goods&#8220;) offered by Vanessa Jung, Jungbuschstra\u00dfe 18, 68159 Mannheim (hereinafter &#8222;Licensor&#8220;) via <a href=\"https:\/\/vanessajung-guitar.de\/en\/\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/vanessajung-guitar.de<\/a>. (2) By purchasing and downloading the Digital Goods, the customer (hereinafter &#8222;Licensee&#8220;) agrees to the terms of this EULA.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u00a7 2 Granting of Usage Rights<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"> (1) The Licensor grants the Licensee a simple, non-transferable, and temporally unlimited right to use the Digital Goods for private purposes. (2) <strong>Live Performances:<\/strong> Notwithstanding the strictly private use, the Licensee is expressly permitted to use the musical works contained in the Digital Goods for their own public live performances (e.g., concerts). Any obligations to pay fees to performing rights organizations (e.g., GEMA\/PRS), which are to be borne by the event organizer, remain unaffected by this.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u00a7 3 Usage Restrictions &amp; Permitted Fan Content<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"> (1) General Restrictions: The Licensee is expressly prohibited from passing on, selling, renting, commercially exploiting the Digital Goods (the files themselves) to third parties, or uploading them to the Internet without authorization. (2) <strong>User-Generated Content (Fan Covers):<\/strong> The creation and publication of the Licensee&#8217;s own audio or video recordings (covers) based on the Digital Goods on social media platforms (e.g., YouTube, Instagram, TikTok) is expressly permitted. This permission applies only provided that the publication by the Licensee does not primarily serve commercial purposes.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u00a7 4 Copyright<\/strong> <\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Digital Goods are protected by copyright. All rights to the content, in particular copyright and ancillary copyright, remain fully with the Licensor.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u00a7 5 Premature Expiry of the Right of Withdrawal<\/strong> <\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In the case of contracts for the supply of digital content not supplied on a tangible medium, the consumer&#8217;s right of withdrawal expires prematurely if the performance of the contract (e.g., the download) has begun after the consumer has expressly consented to this and simultaneously acknowledged that they lose their right of withdrawal once the performance of the contract has begun. This is technically ensured by a confirmation during the checkout process.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u00a7 6 Infringements<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"> In the event of a breach of the provisions of this agreement, the Licensee&#8217;s right of use shall expire with immediate effect. In this case, the Licensee is obliged to immediately delete all copies of the Digital Goods.
